As we enter the final stretch of the school year, our community is buzzing with the energy of spring sports, graduation prep, and the countdown to summer break.
However, with this end-of-year rush often comes a dangerous increase in driver distraction. I am writing to you today with two hats on: one as a concerned neighbor who wants every child to finish the year safely, and the other as your local public defender who sees the legal fallout when safety laws are misunderstood.
Minnesota recently updated its statutes regarding school bus safety, and as traffic picks up during these busy final months, it is vital that every driver understands the change.
The New Standard: It’s All About the Lights
The law has been streamlined to prioritize the bus’s signals over mechanical equipment. The updated language mandates that:
Stop for Red Lights: When a school bus is stopped and displaying flashing red lights, all vehicles must come to a complete stop.
The ‘Stop Arm’ Clause: The previous language regarding the “extended stop arm” has been eliminated. The legal trigger is now the lights themselves; if they are flashing red, you must stop, regardless of whether a physical arm is visible or fully extended.
Keep Your Distance: You must stop at least 20 feet away from the bus.
Stay Put: You must remain stopped until the flashing red lights are deactivated.
Why This Matters
We have seen a troubling rise in local violations recently. From a legal perspective, these aren’t just “simple tickets”—they carry heavy fines and can lead to a criminal record. From a human perspective, the consequences of bypassing a stopped bus are unthinkable.
Our bus drivers are working hard to get our students through these last few months safely, but they cannot control the vehicles around them. That responsibility lies solely with us.
A Community Commitment
During these hectic final weeks of the semester, I encourage every driver to take an extra breath when they see yellow flashing lights and prepare to halt well before that 20-foot mark. Let’s ensure every student in our district makes it to summer vacation safely.
